1. About these terms

These Terms of Business apply between Agentic Hire (“we”, “us”) and any employer or hiring business (“you”, the “Client”) that instructs us to introduce candidates for permanent employment. By submitting a vacancy to us — through our website, by email or otherwise — and continuing to receive our services, you accept these terms.

We act as an employment agency (introducing candidates for direct engagement by you) as defined by the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003. We do not supply temporary workers.

2. Our service

On receiving your vacancy we will confirm the role requirements with you by email, then search, screen and shortlist candidates. Our AI recruitment platform reads every candidate CV in full and scores it against your role; every shortlist is reviewed and pre-screened by a human recruiter before you see it.

We aim to provide a shortlist within days of confirming requirements, but timescales are estimates, not guarantees.

3. Fees — no placement, no fee

No fee is payable unless and until a candidate we introduced starts employment with you. Our fee is a flat 8% of the candidate's gross annual starting salary (or, where the role is part-time, the full-time-equivalent salary pro-rated to the agreed hours), plus VAT where applicable.

The fee becomes payable on the candidate's first day of employment. We will invoice you on or after the start date, and payment is due within 14 days of the invoice date.

4. Replacement guarantee

If a placed candidate resigns or is dismissed for cause within 60 days of their start date, and your account is fully paid up, we will search for one replacement candidate for the same role free of charge. The guarantee does not apply where the role changed materially from the vacancy we filled, or where the candidate leaves due to redundancy, restructure, or a change in terms you made after the offer.

5. Introductions

A candidate is “introduced” when we first send you their details (including an anonymised CV). If you engage an introduced candidate in any capacity — directly or through another party — within 12 months of the introduction, our full fee applies.

If you pass an introduced candidate's details to another business and that business engages them within 12 months, you are liable for our fee as if you had engaged them yourself.

6. Your responsibilities

You are responsible for the final hiring decision, for verifying any matters specific to your workplace, for statutory right-to-work checks before employment starts (we take reasonable steps to confirm eligibility and will tell you what we have checked), and for the terms of employment you offer.

You agree to tell us promptly when an introduced candidate is offered a role, accepts, and starts — including the agreed starting salary.

7. Confidentiality & data

We treat your vacancy details confidentially and never share them beyond what is needed to shortlist candidates. You agree to use candidate details only to assess them for the role introduced, to keep them secure, and to delete them if you do not proceed. Our privacy practices are described in our Privacy Notice.

8. Withdrawal

You may withdraw a vacancy at any time before a candidate starts, at no cost. Likewise, we may decline or withdraw from any assignment. No fee arises from interviews or offers alone — only from a completed start (subject to clause 5).

9. Liability

We take care to present candidates accurately, but we do not employ the candidates and cannot guarantee their performance or conduct. Nothing in these terms limits liability that cannot lawfully be limited; otherwise our total liability in connection with any placement is capped at the fee paid for that placement.

10. General

These terms are governed by the law of England and Wales. If any part is found unenforceable, the rest remains in force. These terms, together with the vacancy details confirmed by email, are the entire agreement for each assignment. We may update these terms from time to time; the version on this page at the date of your vacancy submission applies.
